Whose life takes precedence –from the Micro to the Macro

1.     תלמוד בבלי מסכת נדרים דף פ עמוד ב

ורמי דרבי יוסי אדר' יוסי: מעיין של בני העיר, חייהן  הצורך במים לשתייה, וחיי אחרים — חייהן קודמין לחיי אחרים. להשקיית בהמות בהמתם [ובהמת אחרים — בהמתם] קודמת לבהמת אחרים.  כביסתן וכביסת אחרים — כביסתן קודמת לכביסת אחרים. חיי אחרים וכביסתן — חיי אחרים קודמין לכביסתן. ר' יוסי אומר:  כביסתן קודמת לחיי אחרים, משום שמניעת כביסה יש בה צער מרובה וסכנה. השתא  כביסה  אמר ר' יוסי יש בה צער ועינוי במניעתה, [נדרים דף פא עמוד א] גוף כולו לא כל שכן שאם אינו מתרחץ שיש לו צער? ודוחים: אמרי [אומרים] : אין [כן]צער מניעת כביסה אלימא [חזקה, גדולה] לר' יוסי מצער מניעת רחיצת הגוף. אמר שמואל: האי ערבוביתא דרישא [לכלוך זה שבראש] מתיא [מביא] לידי עוירא [עיוורון], ערבוביתא דמאני [לכלוך שבבגדים] מתיא [מביא] לידי שעמומיתא [שגעון], ערבוביתא דגופא [לכלוך שבגוף] מתיא לידי שיחני וכיבי [שחינים ופצעים]שאין הם כה חמורים כשגעון וכעיוורון. ומכאן יש לומר כי לר' יוסי לכלוך בגדים מסוכן יותר מאשר לכלוך הגוף.
One ruling of R. Jose contradicts another of his: With respect to a well belonging to townspeople, when it is a question of their own lives or the lives of strangers, their own lives take precedence; their cattle or the cattle of strangers, their cattle take precedence over those of strangers; their laundering or that of strangers, their laundering takes precedence over that of strangers. But if the choice lies between the lives of strangers and their own laundering, the lives of the strangers take precedence over their own laundering. R. Jose ruled: Their laundering takes precedence over the lives of strangers. Now, if to -refrain merely from- washing one's garment is a hardship in R. Jose's view [81a] how much more so with respect to the body? — I will tell you: In R. Jose's opinion laundering is indeed of greater importance than bathing. For Samuel said: Scabs of the head -caused by not washing- lead to blindness; scabs -arising through the wearing- of -unclean- garments cause madness; scabs -due to neglect- of the body cause boils and ulcers.

ולכן בפרשה ראשונה של קריאת שמע כתיב ובכל מאדך, ובפרשה והיה לא כתיב ובכל מאדכם, כי פרשת שמע כולה בלשון יחיד נאמרה, ויחיד שאפשר לו, הוא צריך לקיים לא ימוש ספר התורה הזה מפיך דברים ככתבן ממש, לכן נאמר ובכל מאדך פירוש בכל ממונך כמ"ש במשנה סוף ברכות, ר"ל שלא לעסוק בפרנסה כלל, אבל פרשה והיה שנאמרה בלשון רבים, לרבים כמעט מוכרחים להתעסק על כל פנים מעט גם בריוח ממון לחיי נפש, לכן לא כתיב בה ובכל מאדכם. (והגם שעדיין לא זו הדרך והמדרגה הגבוה שבגבוהות לפי אמיתת רצונו יתברך שמו לדעת רשב"י, עם כל זה גם לדידיה לא מקרו ח"ו בזה אין עושין רצונו של מקום כשמפנין עצמם מעט גם לעסק פרנסה ובעת עסקם בפרנסה לבם נוהג בחכמה ומהרהרים בדברי תורה ויראת ה', ולרבי ישמעאל זו היא עיקר רצונו יתברך בהנהנת כלל ההמון, ופלוגתתם מה היא עיקר רצונו יתברך והמדרגה היותר גבוה בהנהגת כלל ההמון):

ו) אכן לענין הלכה, גם דעת העמק שאלה פ' ראה, דאין להכניס בספק סכנה, והטיב אשר דיבר בזה שזה תלוי בפלוגתא דר"ע ובן פטורי בב"מ ס"ב א' ובתו"כ פ' בהר קצת בסגנון אחר, בשנים שהיו מהלכין בדרך ויש לאחד מהם קיתון מים אם שותיהו אחד מגיע לישוב ואם שניהם שותים מתים שניהם, דרש בן פטורי ישתו שניהם וימותו, א"ל ר"ע וחי אחיך עמך חייך קודמים לחיי חברך - ולכאורה דעת בן פטורי תמוה מאד, וכי בשביל שא"א לקיים וחי אחיך מחויב הוא להמית א"ע, ואיזו תועלת תהיה מה שיתן גם לחברו וימותו שניהם. ובמהר"ם שיק יו"ד סי' קנ"ה הקשה בשם הגאון סדר למשנה דל"ל לר"ע קרא, ותיפוק לי' דלא שייך כאן מאי חזית דדמך סומק טפי. ושניהם מתנבאים בסגנון אחד, דהתם איירי דאינו ודאי שימות בעל המים אם יתן לחברו מים, דאולי עד כה יזדמן להם מים ויחיו שניהם, ואם ישתה לבדו בטח יגיע לישוב ויחי' - ודעת בן פטורי דצריך להכניס את עצמו בספק מפני ודאי דחברו, ודעת ר"ע וחי בהם חייך קודמים, ואפילו ספק חיותו כביומא פ"ה ב' וחי בהם דאפילו ספק סכנה דפק"נ דוחה לכל המצות, דוחי משמע ודאי שלא יבא בשום ענין לידי סכנה וכבתוס' שם ד"ה ולפק"ח, והכא נמי דכתיב וחי אחיך עמך ודרשינן חייך קודמין פי' ודאי חייך קודמין - וכידוע דהלכה כר"ע. ומסיים ההעמק שאלה, דכיון דהרי"ף והרא"ש בפרק א"נ הביאו ברייתא זו דשנים שהיו מהלכין בדרך, ממילא נשמע זה הדין - והאי דירושלמי לעיל, דר"ל אמר או קטיל או אתקטיל, זה רק מצד חסידות עי"ש, באופן שכמעט כל הפוסקים, דאין להכניס א"ע בספ"ס בכדי להציל, אם לא מצד חסידות, וגם בזה הרבה פוסקים מביאין דברי הרדב"ז, דהעושה כן הוא בכלל חסיד שוטה - וא"כ הדרינן לני"ד דאם לא עשה בדיעבד פשיטא דאי"צ כפרה ע"ז. ועי' בש"ך רסי' קנ"ז בכל מי שדינו לעבור ואל יהרג, מחלוקת אם מותר להחמיר ע"ע, ומביא בשם תה"ד דבפלוגתא דרבוותא אזלינן לקולא באיסור סכנת נפשות, רק היכא דנוגע לקידוש השם, הוא לפי הענין, אכן יש לחלק בין שארי עבירות ובין מי שרוצה לסכן בעצמו כדי להציל למישהו ממיתה ודאית - ואי לאו סברת הרדב"ז שכתב דמקרי חסיד שוטה, הי' נראה יותר לומר מסברא דמי שעושה כן קדוש יאמר לו - גם יוכל לצמוח מזה, דבניקל יוכל לומר שמתפחד מספק סכנה ולמנוע מלהציל, ודברים כאלו צריכין לשקול במאזני צדק, ולא לעקל הדין רק לטובתו מבלי להשגיח על חיותו של האחר להצילו.

7.     שו"ת שרידי אש חלק ב סימן לד עמוד תכב:ט

אבל לדעתי נראה דסברת בן פטורא היא, שצריכים לחלק בין שניהם. הקיתון של מים דאסור לו להציל עצמו שיוכל לחיות יותר בחיים של חבירו, והיינו כיון שלחייו עכשיו די אם יקח חציו, אסור לו להניח לחבירו למות, ומה שעל ידי זה ימות בעצמו אחר כך לא איכפת לן לדעת בן פטורא, כיון דכעת אין חייו בסכנה צריך ליתן לחבירו שיחיה עמו וכדכתיב "וחי אחיך עמך". אבל הא ודאי למסור נפשו, והיינו דימות עכשיו בעבור חבירו, ודאי לא עלה על דעתו של בן פטורא, ועל זה לא בעינן שום קרא לפטור.
אבל עכשיו השיב ר' עקיבא "חייך קודמין לחיי חברך", ואינו מוכרח לוותר על חייו להציל חבירו, אפילו אינו כעת עומד בסכנה לחייו מ"מ כיון דסוף כל סוף ימות, אינו מחויב לתת הקיתון של מים לחבירו, דהוא בעצמו עדיף.
אבל מ"מ מהאי גמרא ראיה מוכרחת דצריך ליתן כל ממונו, דרק על חייו אין צריך לוותר דחייך קודמין, אבל ממונו אין הכי נמי צריך ליתן. ופדיון שבויים נמי, אם אינו מוצא אחרים שיפדו, הוא בעצמו צריך לתת כל ממונו. וצ"ע על הנושאי כלים של השו"ע, שלא הזכירו בפירוש דצריכים לתת כל ממונו לפדיון שבויים בסכנת נפשות אם אחרים אינם רוצים לסייע, דמהסוגיא דבבא מציעא נראה ודאי להלכה כן.

8.     שו"ת ציץ אליעזר חלק ט סימן מה ד"ה וכפי שאמרו

וכפי שאמרו לי הרופאים (כשהרצאתי לפניהם על נושא זה) הוצאת כליה וכדומה מהאברים הפנימיים מאדם אע"פ שהוא בריא כרוך בסתמא בספק סכנה. ועל כן אין להתנדב על כך בסתמא ואין לרופא לבצע זאת, אא"כ סגל חבורה של רופאים מומחים יחליטו אחרי עיון מדוקדק שהדבר לא כרוך בספק סכנת נפש למנדב, וכולי האי ואולי +לההכרעה שהכרעתי בפנים דבמקום שיש ודאי ספק פיקוח נפש יש מקום לאיסור לאדם לנדב למטרה האמורה אבר מאבריו. התחשבתי שיתכן שאם הנצרך לכך הוא ת"ח דאעפ"י שגם בכה"ג אין חיוב על מי שהוא למסור או לסכן נפשו עבורו אבל מצוה ועכ"פ רשות לסכן א"ע עבורו יש בזה, ועל כן בדומה למקרה שאירע שאשה רוצה להכניס א"ע לספק סכנה לנדב אחת מכליותיה להצלת בנה הלומד תורה שמחוסר ב' הכליות ל"ע, אפשר לומר דמותר לה לעשות זאת ואין כל איסור לסייע בכך ואולי יש עוד מצוה בזה. וחילי דידי ממה שראיתי בספר חסידים סימן תרצ"ח שכותב: שנים שיושבים ובקשו אויבים להרוג אחד מהם אם אחד תלמיד חכם והשני הדיוט מצוה להדיוט לומר הרגוני ולא חבירי כר' ראובן בן איצטרובלי שבקש שיהרגוהו ולא לר' עקיבא כי רבים היו צריכים לר"ע עיי"ש והובא זה גם בשיורי כנה"ג יו"ד סי' קנ"ז הגהב"י אות ל"ה, וכן במג"ע להיעב"ץ ז"ל באבן בוחן פנה א' אות ע"ח. ועוד זאת הוסיף לכתוב היעב"ץ שם באות פ"ה (עפ"י הס"ח הנ"ל) דביודע בבירור שחבירו ת"ח כשר וצדיק יותר ממנו (וכן בשביל אביו ורבו) רשאי למסור עצמו להריגה להצילו מרצון פשוט ומאהבה שאינה תלויה בדבר. וכמו"כ נטה להתיר כשהאב זקן וא"א לו לקיים עוד מצות פ"ו =פריה ורביה= והבן אדם כשר לפחות אפי' אינו גדול כמוהו ולא ממלא מקומו, או שהוא ילד קטן שעדיין לא התנכר במעלליו עיי"ש, ויש עוד הרבה לעיין בזה להלכה. אך עכ"פ יש מקום ללמוד מזה להתיר על כגון דא כשהסכנה אינה ודאית, וכשהמדע הרפואי אומר שהדעה הנותנת היא ששניהם ישארו עי"כ בחיים. לעומת זה לדברים שביארנו בפנים שאין כל חיוב על אדם לנדב אבר מאבריו להצלת חבירו. יעוין במג"ע שם באבן בוחן פנה א' אות ס"ג שכותב נמי בכזאת שאין אדם מחויב להציל באחד מאבריו את הנרדף מזולתו, ואפילו בזיוני דגופא לא מידחי, וכן מעיר גם מזה שהערתי בפנים דבסכנת אבר לפעמים יש בו סכנת כל הגוף ואע"פ שאינו מאברים ראשיים המטריפים, וכמו"כ כותב דגם יסורין קשים ומרים נראה שא"צ לסבול בשביל הצלת חבירו דנגידא קשי ממותא וכמו שאין רשאין למסרו ליסורין בעלילה אם אינו חייב אפילו הן נהרגין אם לא יתנוהו, ק"ו שאין אדם חייב למסור עצמו ביד גוים ליסורין בשביל הצלת חבירו עיי"ש, ונלמד מזה בכל הדומה לזה. ופשוט.+

תַנִי, סִיעוֹת בְּנֵי אָדָם שֶׁהָיוּ מֵהָלְכִין בַּדֶּרֶךְ. פָּגְעוּ לָהֶן גוֹיִם וְאָמְרוּ תְּנּוּ לָנּוּ אֶחָד מִכֶּם וְנַהֲרוֹג אוֹתוֹ וְאִם לָאו הֲרֵי אָנוּ הוֹרְגִים אֶת כּוּלְכֶם. אֲפִילּוּ כּוּלָּן נֶהֱרָגִים לֹא יִמְסְרוּ נֶפֶשׁ אַחַת מִיִּשְׂרָאֵל אבל אם יִיחָדוּ לָהֶן אֶחָד כְּגוֹן שֶׁבַע בֶּן בִּכְרִי שהיה מורד בדוד ונמלט אל אבלה ויואב שם מצור על העיר עד שימסרו לו את שבע בן בכרי יִמְסְרוּ אוֹתוֹ וְאַל יֵיהָרְגוּ. אָמַר רַבִּי שִׁמְעוֹן בֶּן לָקִישׁ, וְהוּא שֶׁיְּהֵא חַיָּיב מִיתָה כְּשֶׁבַע בֶּן בִּכְרִי וְרַבִּי יוֹחָנָן אָמַר אף על פי שֶׁאֵינוֹ חַיָּיב מִיתָה כְּשֶׁבַע בֶּן בִּכְרִי.
עוּלָא בַּר קוֹשַׁב, תַבָעְתֵיהּ מָלְכוּתָא רצו להרגו עָרַק וְאַזִּיל לֵיהּ לְלוֹד גַּבֵּי רַבִּי יְהוֹשֻׁעַ בֶּן לֵוִי. אָתוּן וְאָקְפוּן מְדִינַתָא באו חיילי המלך ועשו מצור אָמְרוּ לָהֶן, אֵין לֵית אָתוּן יְהָבוּן לֵיהּ לָן אֲנַן מְחָרְבִין מְדִינַתָא אמרו להם, אם לא תמסרו לנו אותו נחריב את כל המדינה סַלַק גָבֵּיהּ רַבִּי יְהוֹשֻׁעַ בֶּן לֵוִי וּפָיְּיסֵיהּ וִיהָבֵיהּ לוֹן הלך ריב"ל לעולא בר קושב ופייס אותו למסור את עצמו וְהַוֵה אֵלֵיהוּ זָכוּר לְטוֹב יְלִיף מִתְגָלֵי עָלוֹי וְלָא אֶתְגָלֵי עד אז היה אליהו הנביא מתגלה אל ריב"ל, ומאותו מקרה לא נתגלה אליו וְצָם כַּמָּה צוֹמִין וְאִיתְגָלֵי עָלוֹי צם ריב"ל כמה צומות לדעת מדוע אינו נגלה אליו אָמַר לֵיהּ, וְלַמָּסוֹרוֹת אֲנִי נִגְלָה? אמר לו אליהו, ולמלשינים אני נגלה? אָמַר לֵיהּ וְלֹא מִשְׁנָה עָשִׂיתִי? אמר לו ריב"ל הרי אני עשיתי כמו שכתוב במשנה, ייחדו להם אחד ימסרוהו! אָמַר לֵיהּ, וְזוֹ מִשְׁנַת הַחֲסִידִים? ענה לו אליהו, וכי כך נוהגים חסידים? רַבִּי אֵימִי אִיתְצָד נתפס ע"י גזלנים בְּסִיפְסִיפָה. אָמַר ר' יוֹנָתָן, יִכָּרֵךְ הַמֵּת בִּסְדִינוֹ כלומר, אין דרך להצילו. אָמַר ר' שִׁמְעוֹן בֶּן לָקִישׁ, עַד דְאָנָא קָטִיל אָנָּא מִתְקָטִיל אני אלך להצילו, ואו שאני אהרוג או נהרג על ידם אֲנָּא אֵיזִיל וּמִשֶׁיָּזִיב לֵיהּ בְּחַיָּילָא אני אלך להצילו בכח אָזַל וּפָיֵיסוּן וִיהָבוּנֵיהּ לֵיהּ הלך ופייס אותם והחזירו לו אותו אָמַר לוֹן ר"ל אמר לגזלנים וְאָתוּן גַּבֵּי סַבּוֹן וְהוּא מָצְלִי עָלֵיכוֹן ואתם בואו אצל ר' יוחנן הזקן ויתפלל עליכם אָתוּן גַּבֵּי באו אצל ר' יוֹחָנָן. אָמַר לוֹן, מַה דְּהֲוֵה בְּלִבְּכוֹן אִיעָבַד לֵיהּ יִמְטָא לְהַהוּא עָמֵא מה שרציתם לעשות לו יבוא עליכם לָא מָטוּן אָפִּיפְּסִירוּס עַד דְאָזְלוּן כּוּלְהוֹן לא הספיקו להגיע עד אפיפסירוס עד שמתו כולם.

10.                        בית יוסף יורה דעה סימן קנז אות א ד"ה כל העבירות

בירושלמי (סוף ה"ד) תני סיעת בני אדם שהיו מהלכים בדרך ופגעו בהן גוים ואמרו תנו לנו אחד מכם ונהרוג אותו ואם לאו הרי אנו הורגים את כולכם אפילו כולם נהרגים לא ימסרו נפש אחת מישראל יחדו להם אחד כגון שבע בן בכרי ימסרו אותו ואל יהרגו אמר רבי שמעון בן לקיש והוא שיהא חייב מיתה כשבע בן בכרי ורבי יוחנן אמר אע"פ שאינו חייב מיתה כשבע בן בכרי. ומשמע דהלכה כרבי יוחנן וכן נראה מדברי רבינו שמשון בפירוש המשנה ומדברי הר"ן במסכת יומא (ד. ד"ה ומיהו) וכתבו דהוא הדין לנשים שאמרו להן גוים תנו לנו אחת מכם ונטמאה וכו' שאם יחדוה להם יתנו אותה ואל יטמאו כולן. אבל הרמב"ם בפ"ה מהלכות יסודי התורה (ה"ה) פסק כריש לקיש וצריך טעם למה דהא בכל דוכתא קיימא לן (יבמות לו.) הלכה כרבי יוחנן לגבי ר"ל. ואפשר דפשט לישנא כוותיה דריש לקיש דייקא טפי: וגרסינן תו בירושלמי (שם) עולא בר קסרי תבעתיה מלכותא ערק ואזל ליה ללוד גבי רבי יהושע בן לוי אתון ואקפון מדינתא אמרו להן אין לית אתון יהבין ליה לן אנו מחרבין מדינתא סלק גביה רבי יהושע בן לוי ופייסיה ויהביה לון והוה אליהו זכור לטוב יליף מתגלי עלוי ולא איתגלי וצם כמה צומין ואיתגלי עלוי אמר ליה ולמסורות אני נגלה אמר ליה ולא משנה עשיתי אמר ליה וזהו משנת חסידים היא. משמע דאע"ג דמדינא שרי מכל מקום מדת חסידות הוא שלא לעשות כן ומפני כך כתב הרמב"ם בפ"ה מהלכות יסודי התורה (ה"ה) שאם יחדוהו והוא חייב מיתה יתנוהו להם ואין מורין להם כן לכתחלה:

סיעה של בני אדם שאמרו להם גויים תנו לנו אחד מכם ונהרגנו ואם לאו נהרוג את כולכם, שנינו בתוספתא שיהרגו כולם ואל ימסרו להם נפש אחת מישראל280, ואפילו היו שם כמה אלפים281. ופירשו ראשונים שכיון שאין הגויים מיחדים אחד מהם, נמצא שכשהם בוררים האחד מדעתם, הם פודים את עצמם בישראל אחר, ואין- דוחין-נפש-מפני-נפש, ואף על פי שכולם יהרגו, אסור למסור אחד מהם, שאם ירצו למסור את זה, נאמר להם מה ראיתם שתמסרו את זה, מסרו אחר והצילו את זה, ומה ראית שנפשו של האחר חביבה יותר - היינו שאם נתיר למסור אחד כיון שייהרג בלאו הכי, הרי אפשר למסור גם אחר, וזה לא יהרג, ובטל ההיתר -
